California employment lawyers: GA Steak ‘n Shake workers demand back pay in settings

Atlanta, GA (California employment lawyers News)-Two Steak ‘n Shake restaurant workers in Georgia has demanded the US-based chain Indianapolis burger for violation of various labour legislation. Class action lawsuit filed in federal court against Georgia Steak ‘n Shake the operation Inc. for failing to pay the minimum wage and overtime for hourly employees, reports Eric Grover Keller Grover LLP, California employment and wage and hour law firms.

The plaintiff and current Steak ‘n Shake employee, Justin Beecher and Priscilla Cain, suing the restaurant burger over a number of allegations that the accused in violation of the Fair Labor Standards restaurants Act, Indianapolis Business Journal reports.

Wage and hour lawsuits argue that the Steak ‘n Shake restaurant manager ordered to match the number of hours for employees who work more than 40 hours a week, to avoid overtime pay wages. In fact, the lawsuit claimed the documents were created by the Steak ‘n Shake is called “an audit trail report,” which shows the edited “clock in” and “clock” time to hourly employees.

In addition, the suit claims chain burger neglected to pay the minimum wage that is right for the server to get tips, by adjusting the number of false tip to reflect higher amounts. Because of this, the company eliminated the difference between a regular server hourly rate and the Federal minimum wage is required, and thus passing through an obligation to pay the minimum wage differential, the lawsuit reads.

In addition, Steak ‘n Shake allegedly changed the server clock to show lower numbers to increase the regular hourly rate them, and to avoid paying minimum wage differential.
